BELIEVR - Terms of Service

These Terms of Service ("Terms") govern your use of the BELIEVR mobile application and related services (collectively, the "App" or "BELIEVR"). By downloading, accessing or using BELIEVR, you agree to these Terms. If you do not agree, do not use the App.

1. Purpose of the App

BELIEVR is a triathlon and running training and coaching app that provides training plans, analytics, coaching insights and related functionality for endurance sports, including the optional AI coach "Coach AI" (see section 6). The App provides general training guidance. It does not provide medical, diagnostic or professional healthcare advice.

2. Eligibility

You may only use BELIEVR if:

  • You are at least 18 years old, and

  • You have the legal capacity to enter into a binding contract under applicable law.

By using the App, you confirm that these conditions are met.

3. Accounts & Registration

To use BELIEVR, you need to create an account or sign in via a third-party provider (e.g. Apple, Google).

You agree to:

  • Provide accurate, current and complete information.

  • Keep your login credentials confidential and secure.

  • Be responsible for all activities that occur under your account.

If you suspect unauthorised access, please notify us immediately at support@joinbelievr.com.

4. Subscriptions, Free Trials & Billing

4.1 Subscription Plans

BELIEVR may offer different subscription options (e.g. monthly or yearly) (each a "Subscription"). Prices, features and durations are shown in the App and in the App Store listing. All billing, renewals and payment processing are handled by Apple (App Store), not directly by BELIEVR.

4.2 Free Trial

We may offer a free trial period (e.g. 14 days). After the trial ends, your Subscription automatically converts to a paid Subscription and the applicable fee is charged unless you cancel in time via your App Store account.

4.3 Auto-Renewal & Cancellation

Unless cancelled at least 24 hours before the end of the current period, your Subscription automatically renews and your App Store account is charged for the next period.

To cancel or manage your Subscription, go to Settings → Apple ID → Subscriptions on your iPhone, or https://apps.apple.com/account/subscriptions

Cancelling a Subscription stops future charges but does not automatically entitle you to a refund for periods already charged.

4.4 Refunds

Apple handles refund requests according to its policies. We do not process or control refunds directly.

5. Use of the App & Health Disclaimer

You understand and agree that:

  • BELIEVR does not provide medical advice, diagnosis or treatment.

  • BELIEVR is not a substitute for consultation with a doctor, physiotherapist or other qualified healthcare professional.

  • Training for endurance sports (e.g. triathlons, marathons, Ironman events) involves significant physical stress and a risk of injury or health complications.

Before starting or modifying any training plan, you should consult a qualified doctor and make sure you are medically cleared for intense endurance training.

Stop training and seek medical help if you feel pain, dizziness, chest pain, shortness of breath or other warning signs. In an emergency, call your local emergency number.

You are responsible for your own health, training choices and performance.

6. Coach AI (optional)

6.1 What Coach AI is

Coach AI is an optional feature that uses artificial intelligence to write a daily training brief, answer your questions in the Coach chat and explain changes to your plan. It is off until you turn it on in the App and give your consent to the processing described in our Privacy Policy (section 2.8). You can turn it off at any time under Settings → Coach.

6.2 AI-generated guidance

Coach AI's answers are generated automatically by an AI model. They can be incomplete, out of date or wrong, even when they sound confident, and they are based only on the data available to BELIEVR. Coach AI is not a human coach and not a medical service. It does not diagnose, treat or replace advice from a doctor or other healthcare professional. If Coach AI suggests seeing a doctor, please take that seriously.

6.3 You stay in charge of your training

You decide whether to follow a brief, an answer or a suggested plan change. Check that guidance fits how you feel, your health and your circumstances before you act on it, and don't train through pain or illness because the App suggests a session. Section 5 applies in full to Coach AI.

6.4 Acceptable use of the Coach chat

When using Coach AI, you agree not to:

  • Try to make Coach AI ignore its instructions or safety rules, reveal its internal instructions, or produce content it is designed not to produce (e.g. "jailbreaks" or prompt injection).

  • Use Coach AI for purposes other than your own training, for example to get advice for other people, to generate content unrelated to training, or for commercial use.

  • Access Coach AI by automated means (bots, scripts) or try to get around usage limits.

  • Enter content that is illegal, harassing, hateful, sexually explicit, or that infringes other people's rights.

  • Enter other people's personal data or sensitive information you don't need to share (e.g. passwords, payment details, identity numbers).

An automatic check screens Coach chat messages. Flagged messages may be reviewed by authorised BELIEVR staff to keep Coach safe, as described in our Privacy Policy (section 2.8). If you misuse Coach AI, we may limit or switch off Coach AI for your account, and section 9 applies.

6.5 Availability and limits

Coach AI depends on third-party AI services. It may be unavailable at times, respond slowly or offer less, and we may set usage limits (e.g. a number of messages per day), change models, or change, reduce or discontinue Coach AI features. When Coach AI is unavailable or switched off, BELIEVR continues to provide its rule-based coaching and plan adjustments. Features and limits may depend on your Subscription.

6.6 Your content

You keep all rights to the messages you write. You allow us to process them to provide Coach AI to you as described in our Privacy Policy. We do not use your messages to train AI models.

7. Third-Party Integrations (e.g. Garmin, Apple Health)

BELIEVR integrates with third-party services such as Garmin Connect, Apple Health and Apple Watch (collectively, "Third-Party Services").

By connecting a Third-Party Service, you authorise BELIEVR to:

  • Access and process data made available by that service (e.g. activity data, training metrics, sleep and recovery data, heart rate information), and

  • Use such data to provide training plans, analytics and App features, and

  • Send your planned workouts to that service or device, if you turn this on.

You can disconnect integrations at any time in the App or in the Third-Party Service. Use of Third-Party Services is governed by their own terms and privacy policies; BELIEVR is not responsible for their content, availability or actions.

8. Intellectual Property

All content within the App, including training plans, algorithms, text, graphics, logos, icons, images, UI elements and software, is owned by or licensed to BELIEVR and is protected by copyright, trademark and other intellectual property laws.

Subject to your compliance with these Terms, BELIEVR grants you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial use.

You may not:

  • Copy, modify, distribute, sell, lease or sublicense the App or any part of it.

  • Reverse engineer, decompile or attempt to derive the source code, except where the law expressly allows it.

  • Use the content, algorithms or Coach AI output to develop a competing service.

9. Acceptable Use & User Conduct

When using BELIEVR, you agree not to:

  • Use the App for unlawful, harmful or abusive purposes.

  • Upload or share content that is illegal, defamatory, discriminatory or otherwise inappropriate.

  • Interfere with the security or operation of the App.

  • Attempt to gain unauthorised access to any systems or accounts.

We may suspend or terminate your access if you violate these Terms (including section 6.4) or use the App in a way that we reasonably believe is harmful. Where reasonable, we will warn you first.

10. No Guarantee of Results

Training plans, recommendations, Coach AI guidance and analytics in BELIEVR are based on general training principles and the data available to us. They are not guaranteed to produce specific results (e.g. race times, placements or performance improvements).

Your progress depends on many factors outside our control, including your health, consistency, recovery, sleep, nutrition, stress and environmental conditions.

11. Disclaimers

We work to keep BELIEVR available, accurate and secure, but we cannot guarantee that the App will be uninterrupted or error-free, or that every training suggestion, Coach AI answer or piece of data is complete, accurate or suitable for your individual needs. Your statutory rights, in particular for defects of a paid Subscription, remain unaffected.

12. Limitation of Liability

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz), and where we have given a guarantee.

For slight negligence, we are liable only for breaches of essential contractual obligations, i.e. obligations whose fulfilment makes the proper performance of the contract possible in the first place and on which you may regularly rely. In that case, our liability is limited to the typical damage foreseeable when the contract was concluded.

Otherwise, our liability for slight negligence is excluded. These limitations also apply to the personal liability of our employees, representatives and agents.

13. Changes to the App, the Service and these Terms

We may develop BELIEVR further and update, modify or discontinue parts of the App, including features, training content, Coach AI and subscription offerings. Changes that affect a paid Subscription will be reasonable for you, taking your interests into account.

We may update these Terms, for example when we add features or when the law changes. We will inform you of material changes in the App or by email before they take effect and update the "Last updated" date above. If you do not agree to the changes, you can stop using BELIEVR, cancel your Subscription and delete your account.

14. Termination

You may stop using BELIEVR at any time and can delete your account in the App or by contacting us. Cancelling an App Store Subscription is done through Apple (see 4.3).

We may suspend or terminate your access to BELIEVR if:

  • You violate these Terms,

  • You misuse the App, including Coach AI, or abuse other users, or

  • We are required to do so by law or regulatory obligations.

Upon termination, you lose access to the App and the data stored in it. Termination does not affect rights or obligations that by their nature should survive (e.g. payment obligations, limitations of liability).

15. Governing Law & Jurisdiction

These Terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country where you have your habitual residence.

If you are a merchant (Kaufmann) or a legal entity under public law, the exclusive place of jurisdiction is Munich, Germany. If you are a consumer, the statutory rules on jurisdiction apply.

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
